There are a variety of employee benefits compliance considerations related to employees returning to work, either after a furlough or termination. This discussion will address reinstatement of benefits, cafeteria plan election changes, FSA (health and dependent care) considerations, ACA rehire and waiting period rules, employer reporting, premium payments (including collecting employee deductions in arrears), COBRA matters and tools to assess the cost impact of COVID-19 on self-insured plans.
